You will find our General Terms and Conditions on this page. These always apply if you use or place an order through our webshop and contain important information for you as a buyer. It is advisable to read the terms and conditions and to understand them. If there is any doubt or lack of clarity, you must contact us immediately.

• A customer is that natural or legal person, whether or not acting in a professional or company capacity that enters into an Agreement with Bikes2Bits.com
• An agreement is any agreement between Bikes2Bits.com and the Customer, for which the General Terms and Conditions form an integral part.
• A trader is the natural or legal person who offers his parts via the webshop.

Applicability of General Terms and Conditions

• The General Terms and Conditions apply to all offers, agreements and deliveries via Bikes2Bits.com, unless explicitly agreed otherwise in writing.
• If the Client includes provisions or conditions that deviate from, or do not appear in, the General Terms and Conditions in its order, confirmation or notice of acceptance, these are only binding for Bikes2Bits.com if and insofar as Bikes2Bits.com has explicitly accepted them in writing. .
• In the event that specific product or service terms and conditions apply in addition to these General Terms and Conditions, those terms and conditions also apply, but in the event of conflicting terms and conditions, the Customer may always invoke the applicable provision that is most favorable to him.
• Bikes2Bits.com explicitly rejects deviating provisions or conditions on the part of the trader.

Prices and VAT

• All prices stated on the webshop and in other materials originating from Bikes2Bits.com include VAT and, unless stated otherwise on the webshop, other levies imposed by the government.
• Second-hand parts fall under the margin scheme. This is £ European. VAT on second-hand parts is therefore not recoverable.
• If shipping costs are charged, this will be clearly stated in time for the conclusion of the agreement. In addition, these costs will be shown separately in the ordering process.
• Shipping costs fall under the normal VAT regime. VAT can be recovered here.
• If the part is sent to a European country other than the part's origin, the transport cost will fall under the intra-Community VAT system.
• All prices and other information on the webshop and in other materials originating from Bikes2Bits.com are subject to obvious programming and typing errors. Bikes2Bits.com is not liable for displaying incorrect prices that the Customer may assume to be manifestly incorrect. If the Client discovers that incorrect prices have been stated, the Client has the option to report this to Bikes2Bits.com.


Information
• The content of the webshop has been compiled with the greatest care. However, Bikes2Bits.com cannot guarantee that all information on the webshop is correct and complete at all times and is therefore not liable for this.
• Bikes2Bits.com cannot be held responsible for (color) deviations due to screen quality, discoloration due to age, non-original paint, etc.


Realization of the agreement
• The agreement is concluded at the moment of acceptance by the Customer of the offer from Bikes2Bits.com and compliance with the conditions set by Bikes2Bits.com.
• If the Customer has accepted the offer electronically, Bikes2Bits.com will immediately confirm receipt of the acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed, the Client has the option to terminate the agreement.
• If it turns out that incorrect information was provided by the Customer when accepting or otherwise entering into the agreement, Bikes2Bits.com has the right to fulfill its obligation only after the correct information has been received.
• Bikes2Bits.com can inform itself within legal frameworks whether the Customer can meet its payment obligations, but also of all facts and factors that are important for a responsible conclusion of the agreement. If, based on this investigation, Bikes2Bits.com has good reasons not to enter into the agreement, it is entitled to refuse an order or request, or to attach special conditions, such as prepayment, to the implementation.


Execution Agreement
• Once the order has been received by Bikes2Bits.com, Bikes2Bits.com will send the parts as soon as possible.
• Bikes2Bits.com and trader are entitled to engage third parties in the performance of the obligations arising from the agreement.
• The Webshop clearly, timely before the conclusion of the agreement, describes how delivery will take place and within which period the parts will be delivered. If no delivery period has been agreed or stated, parts will in any case be delivered within 20 days.
• If Bikes2Bits.com cannot deliver the parts within the agreed period, it will inform the Customer thereof. In that case, the customer can agree to a new delivery date or he will be given the option to terminate the agreement free of charge.
• If Bikes2Bits.com cannot deliver the part whatsoever, he will inform the customer and the agreement will automatically end.
• Bikes2Bits.com advises the customer to inspect the parts supplied and to report any defects found within a reasonable time, preferably in writing or by e-mail. See our return policy and warranty policy for this.
• As soon as the parts to be delivered have been delivered to the specified delivery address, the risk with regard to these parts will be transferred to the customer. If explicitly agreed otherwise, the risk is transferred to the Customer earlier. If the Customer decides to collect the parts, the risk passes when the parts are transferred.
• If the goods are delivered to a collection point, neighbor, etc., the customer will be notified by the third party responsible for transport and the risk will be transferred to the customer.
• Bikes2Bits.com is entitled to deliver a similar part of similar quality as the ordered part, if the ordered is no longer available.


Right of withdrawal and return
• This article only applies if the customer is a natural person who is not acting in the exercise of his profession or business. Business Customers are therefore not entitled to a right of withdrawal.
• Customer has the right to terminate the distance agreement with Bikes2Bits.com within 14 calendar days after receipt of the part, without giving reasons, free of charge. The return period starts on the day after the Customer, or a third party designated by him in advance, who is not the carrier, has received the part that forms part of the agreement.
• Furthermore, all provisions can be found under our Return Policy, Return Period and Warranty Provisions in full force.
• During the return period, the customer will handle the part and the packaging with care. Customer will only open the package and only use the part to the extent necessary to ascertain the nature, characteristics and operation of parts. The basic principle here is that this inspection may not go beyond what the Client could do in a physical store.
• Customer is liable for value reduction of the part that is the result of a way of handling the part that goes beyond what is permitted in the previous article
• Customer can terminate the agreement in accordance with Return Policy, Return Term and Warranty Provisions during the stipulated period by filling in the return form on his account page and stating the reason and the order number and sending it digitally to Bikes2Bits.com, after which Bikes2Bits.com receives the receipt of the return form.
• The date of receipt of the return form determines whether the cancellation is within the specified period or outside.
• If a valid return request has been submitted and this has been received by Bikes2Bits.com within the return period, the return procedure will be started as described in the Return Policy.
• Customer can use the sent shipping order and will further organize the collection itself with the third party responsible for the transport. If the customer chooses to organize the transport himself, the customer will inform Bikes2Bits.com and the shipping address of the trader will be sent by email.
• The amount to be refunded for the part will, after any settlement with transport costs, see our return policy, be repaid to the customer at the latest within 14 days after receipt of the returned part on the account number that the customer has entered on the return form.
• If the Customer has opted for a more expensive method of delivery than the cheapest standard delivery when ordering the part, Bikes2Bits.com does not have to reimburse the additional costs for the more expensive method
• The webshop clearly refers to the Return Policy, Return Period and Warranty Terms in a timely manner before concluding the agreement.


Payment - Reservation period
• Customer pays the agreed total price to Bikes2Bits.com according to the payment method agreed in the order procedure. Bikes2Bits.com is free in the choice of offering payment methods and these may also change from time to time.
• Except if the customer chooses to collect the part, the customer will pay the agreed total price before the part is sent.
• After completing the order procedure and agreeing to the conditions, the reservation period of 7 days starts. From this moment on the part will be reserved for the customer and will no longer be offered for sale on the webshop. Insofar as the customer has not opted for an automatic payment method and the customer fails to pay the payment during this reservation period, the agreement will be terminated and the part will be offered for sale again. In any case, the customer will be reminded by email during the reservation period to make the payment within the stipulated period of 7 days.
• If the agreement is terminated automatically, the customer will be notified by email, thereby relieving both Bikes2Bits and the customer of all obligations that originate in the agreement.
• The agreement will not be terminated automatically in the case of non-returnable parts (see description in the return policy) or Bikes2Bits chooses not to terminate the agreement.
• In any case, any collection costs, legal costs, interest and all other costs arising from non-compliance with the agreement will be borne by the customer


Warranty and conformity
• This article only applies if there is a Customer who is not acting in the exercise of his profession or business. If a separate warranty is given by Bikes2Bits.com for the parts, this applies to all types of Customers, without prejudice to the just stated.
• The dealer guarantees that the parts comply with the Agreement, the specifications stated in the offer, the reasonable requirements of reliability and / or usability and the legal provisions and / or government regulations existing on the date of the conclusion of the agreement.
• If specifically agreed, the dealer also guarantees that the part is suitable for other than normal use.
• If the part delivered does not comply with the agreement, the Client must inform Bikes2Bits.com of this within a period of 5 days after it has received the part.
• If Bikes2Bits.com considers the complaint to be justified, the relevant parts will be repaired, replaced or reimbursed after consultation with the Customer. With due observance of the Article on liability, the maximum reimbursement is equal to the price paid by the Client for the part.

Complaints procedure
• If the Customer has a complaint about a part (in accordance with the general terms and conditions, the Return Policy, Return Period and Warranty Provisions) and / or about other aspects of the services of Bikes2Bits.com, he can contact Bikes2Bits.com by phone, e-mail or submit a complaint by post.
• Bikes2Bits.com gives the Client a response to his complaint as soon as possible, but in any case within 14 days after receiving the complaint. If it is not yet possible to give a substantive or definitive response, then Bikes2Bits.com will confirm within 14 days after receiving the complaint and give an indication of the period within which it expects to give a substantive or definitive response to the complaint from Customer.


Liability
• This article only applies if the Client is a natural or legal person who is acting in the exercise of his profession or business.
• The total liability of Bikes2Bits.com vis-à-vis the Customer for attributable failure to comply with the agreement is limited to reimbursement of a maximum of the amount stipulated for that agreement (including VAT).
• Liability of Bikes2Bits.com towards the customer for indirect damage, including in any case - but explicitly not exclusively - consequential damage, lost profit, lost savings, loss of data and damage due to business interruption, is excluded.
• Apart from the cases mentioned in the previous two paragraphs of this article, Bikes2Bits.com is not liable to the customer for any compensation whatsoever, regardless of the grounds on which an action for compensation would be based. The limitations mentioned in this article will, however, lapse if and insofar as damage is the result of intent or gross negligence on the part of Bikes2Bits.com.
• The liability of Bikes2Bits.com towards the customer due to imputable shortcoming in the performance of an agreement arises only if the Customer immediately and properly declares Bikes2Bits.com to be in default in writing, thereby stipulating a reasonable period for clearing the shortcoming, and Bikes2Bits.com also after that period continues to fall short in the fulfillment of its obligations. The notice of default must contain as detailed a description as possible of the shortcoming, so that Bikes2Bits.com is able to respond adequately.
• The condition for any right to compensation is always that the Customer reports the damage in writing to Bikes2Bits.com as soon as possible, but at the latest within 30 days after its occurrence.
• In the event of force majeure, Bikes2Bits.com is not obliged to compensate for any damage caused to it by the Client.
• Furthermore, all provisions can be found under our Return Policy, Return Period and Warranty Provisions in full force.


Retention of title
As long as the customer has not made a full payment for the entire agreed amount,
all delivered goods remain the property of the trader.

Personal data
• Bikes2Bits.com processes the personal data of the customer in accordance with the privacy statement published on the webshop.
• The personal data that Bikes2Bits.com obtains from Customers is only used for the implementation of the Agreement and for making offers for similar parts and services.
• For the implementation of the agreement, Bikes2Bits.com may pass on the personal data to the Merchant with which.


Final provisions
• Belgian law applies to the agreement.
• Unless otherwise provided by mandatory law, all disputes that may arise under the Agreement will be submitted to the competent court in the district where the registered office of Bikes2Bits.com is located.
• If a provision in these General Terms and Conditions turns out to be invalid, this does not affect the validity of the entire General Terms and Conditions. The parties will in that case replace (a) new provision (s), which will give shape to the intention of the original provision as much as possible in law.
• The term "in writing" in these General Terms and Conditions also means communication by e-mail and fax, provided that the identity of the sender and the integrity of the e-mail are sufficiently established.
